TERMS AND CONDITIONS (AGB)
These Terms and Conditions (AGB) apply to all services offered by Karin Leuthardt, in particular photographic tours, workshops, photoshoots, as well as orders placed through the online shop and the associated service packages.
TERMS FOR PHOTOGRAPHIC TOURS
1. Scope
These Terms apply to all photographic tours offered by Karin Leuthardt.
They govern the contractual relationship between Karin Leuthardt and the participants (hereinafter referred to as “participants”).
Any differing terms of the participant shall not be accepted unless expressly agreed in writing by Karin Leuthardt.
2. Booking and Contract Conclusion
The presentation of photographic tours on the website does not constitute a legally binding offer, but rather an invitation to book.
By booking a photographic tour, whether via the booking system, by email or by other means, the customer submits a binding offer to conclude a contract.
The contract is only concluded upon written confirmation by Karin Leuthardt.
After conclusion of the contract, the participant will receive a booking confirmation containing all relevant information.
3. Payment and Deposit
Upon conclusion of the contract, a deposit of 30% of the total price is due, unless otherwise agreed.
The remaining balance must be paid no later than 30 days before the start of the trip.
For bookings made less than 30 days before the start of the trip, the full amount is due immediately.
If payment is not made on time, Karin Leuthardt reserves the right to withdraw from the contract and reassign the booked place. Cancellation fees may apply.
4. Cancellation by the Participant
The participant may withdraw from the contract at any time before the start of the trip. The withdrawal must be made in writing.
The following cancellation fees apply:
– up to 120 days before the trip: 30% of the total price
– 119 to 60 days: 50%
– 59 to 30 days: 75%
– from 29 days before the trip or in case of no-show: 100%
The decisive date is the receipt of the cancellation.
The participant may nominate a substitute person, provided they meet the requirements and no organizational reasons prevent it.
It is strongly recommended to take out travel cancellation insurance.
5. Services and Changes
The scope of services is determined by the description on the website and the booking confirmation.
Karin Leuthardt reserves the right to make changes for justified reasons, provided they do not significantly alter the overall character of the trip.
Changes may occur due to weather conditions, official regulations, safety considerations or unforeseen circumstances.
No guarantee is given for the sighting of specific animals, lighting conditions or individual photographic results.
The itinerary may be adapted to ensure optimal photographic conditions.
6. Minimum Number of Participants
The tour is subject to a minimum number of participants.
Karin Leuthardt reserves the right to cancel the trip if this number is not reached. In this case, all payments made will be fully refunded.
Participants are advised to book flights and additional services only after written confirmation of the trip.
No liability is assumed for costs already incurred.
7. Liability
Karin Leuthardt is only liable in cases of intent or gross negligence.
Participation is at the participant’s own risk.
Each participant is responsible for their own equipment and physical condition.
No liability is assumed for loss, theft or damage to personal equipment.
No liability is assumed for services provided by third parties (e.g. accommodation, transport, local guides).
8. Image Rights
During the tours, photos and videos may be taken in which participants are recognizable.
The participant agrees that Karin Leuthardt may use this material for marketing and presentation purposes (website, social media, portfolio, print materials).
If a participant does not agree, this must be communicated in writing before the start of the trip.
Copyright of the images remains with the respective photographer.
TERMS FOR PHOTO SHOOTS
1. Scope
These Terms apply to all photoshoots offered by Karin Leuthardt and the associated service packages.
2. Booking and Contract Conclusion
The presentation of shooting packages does not constitute a binding offer.
By booking a photoshoot, the customer submits a binding offer.
The contract is concluded only upon written confirmation.
3. Payment
Payment is made according to the conditions specified at booking.
Karin Leuthardt reserves the right to request a deposit.
The full amount must be paid no later than the day of the shoot unless otherwise agreed.
4. Appointment, Rescheduling and Cancellation
The agreed appointment is binding.
Free cancellation or rescheduling is possible up to 7 days before the appointment.
Within 7 days: 50% of the price
Within 48 hours or no-show: 100%
In case of illness or unforeseen circumstances, a new appointment may be arranged.
Photoshoots depend on suitable weather conditions.
Delays may lead to a shortened session.
5. Services
The photographic service is provided according to the booked package.
Creative direction, image selection and editing are at the discretion of Karin Leuthardt.
The client accepts the photographer’s style.
There is no entitlement to receive RAW files.
6. Delivery of Images
Final images are delivered digitally within a reasonable timeframe.
The number of images depends on the booked package.
Further editing by the client is only permitted with prior approval.
7. Usage Rights
After full payment, the client receives a simple right of use for private purposes.
Commercial use requires prior written agreement.
Karin Leuthardt reserves the right to use images for marketing purposes.
Any objection must be made in writing before the shoot.
8. Liability
Participation is at the client’s own risk.
No liability is assumed unless caused by intent or gross negligence.
The client is responsible for their animal’s behavior.
9. Animal Health
The animal must be in good health.
If the animal is sick, injured or stressed, the shoot may be stopped for welfare reasons.
In such cases, no full refund is guaranteed.
10. Vouchers
Vouchers may be purchased and redeemed within their validity period.
Cash redemption is excluded.
Transfer is allowed unless otherwise agreed.
TERMS – ONLINE SHOP
1. Scope
These Terms apply to all orders placed through the online shop of Karin Leuthardt Photography.
2. Offer and Contract Conclusion
Products displayed do not constitute a binding offer.
By placing an order, the customer submits a binding offer.
The contract is concluded upon order confirmation.
3. Prices and Payment
All prices are final unless stated otherwise.
Payment is made via the available payment methods.
4. Delivery and Shipping
Delivery is made to the address provided by the customer.
Shipping costs are shown separately.
Delivery times depend on the product and may vary.
Delays cannot be excluded.
5. Retention of Title
Goods remain the property of Karin Leuthardt until full payment is received.
6. Right of Withdrawal
Customers have the right to withdraw within the statutory period.
Details are set out in the withdrawal policy.
7. Returns and Complaints
Goods must be checked upon receipt.
Visible defects must be reported within 5 days.
In justified cases, replacement or refund will be provided.
8. Liability
Liability applies only in cases of intent or gross negligence.
9. Copyright
All content is protected by copyright.
Use without permission is prohibited.
10. Final Provisions
The law of the country of Karin Leuthardt’s place of business shall apply.
If individual provisions are invalid, the remaining provisions remain effective.
